1. Acceptance of Terms

By accessing and using the FQB Transfer platform ("Service"), you ("User") agree to be bound by these Terms and Conditions. If you do not agree with these terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Five Quantum Bits, a company registered in Romania. By creating an account or using any functionality of the platform, you confirm that you have read, understood, and fully accepted these Terms.

FQB Transfer reserves the right to modify these Terms at any time. Continued use of the Service after changes are made constitutes acceptance of the updated Terms.

2. Description of Services

FQB Transfer provides a software-as-a-service (SaaS) platform for evaluating and improving web accessibility in accordance with WCAG 2.2 standards and applicable Romanian legislation, including Law 232/2022.

Services include:

  • Automated Scanning – technical analysis of websites to identify accessibility issues
  • Accessibility Widget – real-time accessibility enhancement tool
  • Reports and Analytics – compliance documentation and remediation recommendations
  • WCAG Certification – issuance of compliance certificates for verified websites
  • Continuous Monitoring – periodic automated checks to maintain compliance
  • Technical Support – assistance with implementation and usage

Services are provided “as is” and may be modified, suspended, or discontinued at any time, with or without prior notice. FQB Transfer does not guarantee uninterrupted availability of the Services.

3. User Account

3.1 Registration

To use the Service, you must create an account by providing complete and accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must be at least 18 years old to create an account. If you act on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3.2 Account Security

You are required to:

  • Keep your password and authentication details confidential
  • Immediately notify FQB Transfer of any unauthorized use of your account
  • Use strong and unique passwords
  • Not share account access with unauthorized persons
  • Log out after each session on shared devices

FQB Transfer is not responsible for losses resulting from unauthorized account access.

3.3 Account Suspension

FQB Transfer reserves the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or pose a security risk. In case of suspension, you will be notified by email with details and resolution steps.

4. Subscriptions and Payments

4.1 Subscription Plans

FQB Transfer offers multiple subscription plans with different features and limits. Pricing and plan details are displayed on the website and may change with prior notice.

All subscriptions include a 14-day free trial. After the trial ends, you will be charged automatically unless you cancel before the trial period expires.

4.2 Billing

Payments are processed monthly or annually, depending on the selected plan. All payments are made in advance. By providing payment details, you authorize FQB Transfer to charge the applicable subscription fee at each billing cycle.

Prices are displayed in RON (Romanian Lei) and include VAT where applicable. A fiscal invoice will be issued for each payment.

4.3 Automatic Renewal

Subscriptions renew automatically at the end of each billing period unless canceled before the renewal date. A reminder email will be sent 7 days prior to renewal.

4.4 Cancellation and Refunds

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. No partial refunds are provided, except where required by law.

In case of major technical issues preventing Service use for a significant period, you may request a proportional refund by contacting support.

4.5 Late Payments

If a payment fails, you will be notified and granted a 7-day grace period to update payment details. After this period, the account may be suspended until payment is resolved.

5. Use of the Platform

5.1 License

FQB Transfer grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms, valid while your subscription is active.

5.2 Usage Restrictions

You may not:

  • Copy, modify, distribute, or create derivative works from the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service for unlawful or unauthorized purposes
  • Attempt to gain unauthorized access to FQB Transfer systems
  • Interfere with normal operation of the Service
  • Transmit malware, spam, or harmful content
  • Resell or redistribute Service access without written consent
  • Use bots or automated scripts to access the Service

5.3 Usage Limits

Each subscription plan includes specific limits on websites, scanned pages, and API requests. Exceeding limits may result in additional charges or temporary service suspension.

6. Intellectual Property

6.1 Ownership

All rights, title, and interest in the Service, including software, algorithms, design, trademarks, content, and documentation, remain the exclusive property of FQB Transfer or its licensors. No ownership rights are transferred under these Terms.

6.2 User Data

You retain all rights to data you upload or generate through the Service. You grant FQB Transfer a limited license to process this data solely to provide the Service.

6.3 Feedback

Any feedback or suggestions you provide may be used by FQB Transfer without obligation or compensation.

7. Privacy and Data

Personal data processing is governed by our Privacy Policy, which forms an integral part of these Terms. FQB Transfer complies fully with GDPR and applicable Romanian data protection laws.

8. Limitation of Liability

The Service is provided “as is” and “as available,” without warranties of any kind. FQB Transfer does not guarantee uninterrupted, error-free, or secure operation.

To the maximum extent permitted by law, FQB Transfer shall not be liable for indirect, incidental, special, or consequential damages, loss of profits, data, or business opportunities.

Total liability shall not exceed the amount paid for the Service in the last 12 months or 1000 RON, whichever is greater.

9. Changes to the Terms

FQB Transfer may update these Terms at any time. Material changes will be communicated by email at least 30 days in advance where required by law.

Governing Law

These Terms are governed by the laws of Romania. Any disputes shall be resolved by the competent courts of Bucharest, Romania.
